Simply Trees Terms of Service

Simply Trees Terms of Service

By placing an order with Simply Trees, you agree to the following terms:

Simply Trees Product Guarantee

At Simply Trees, we guarantee that your plants and trees will arrive healthy and vibrant. If you're not satisfied within the first five days of receiving your trees and plants, contact us, and we'll help make it right! Please note that proper care and nutrients are necessary for plants to adapt to their new surroundings. Our guarantee does not cover plants purchased outside your recommended growing zone or those that have received inadequate care.

If you encounter problems with your plants within the first 30 days, contact us. We'll review your concerns and, if necessary, provide you with store credit or replacement.

A store credit will be issued for the product(s) in question, reflecting the exact amount the customer paid at the time of purchase. This means if the customer purchased the item(s) at a sale price, they will receive a store credit equal to that discounted price, irrespective of whether the item(s) is currently on sale or not.

For deciduous trees ordered between fall (October 15th and beyond) or early spring that don't emerge from dormancy by June 15th, we'll honor our guarantee outside of the five-day notification period. Please contact us by June 15th so we can review and assist with your order. We kindly request photos to help us assist you in saving your tree or plant.

Shipping

We pride ourselves on the accuracy of our shipping dates (over 95% accurate!). However, external factors may cause delays. While we strive to maintain accurate shipping estimates, exact shipping dates cannot be guaranteed.

Please note, our shipping times are calculated in business days, which are Monday through Friday. Our carrier does not pick up orders from our facility on Saturdays or Sundays at this time.

Shipping live products can be challenging. In cases of extreme weather, we may temporarily delay shipping to ensure the well-being of your plants. Our primary focus is on delivering healthy and thriving plants to you. Rest assured, we'll make every effort to notify you of any delays promptly.

California Orders
Due to USDA regulations and laws instated by the California Department of Agriculture, all plants shipped from our fulfillment center to customers in California must undergo inspection by the USDA for pests and diseases prior to departure. The USDA typically conducts inspections once a week on Tuesdays. If you place your order after the USDA has completed their inspections, your order will be shipped the following Tuesday once the USDA has inspected our plants again. We apologize for any inconvenience this may cause. If you have any questions or concerns, please feel free to chat with us or send an email.

Houseplants and Sensitive Plants
Due to the nature of houseplants and certain sensitive plants, we avoid shipping these items on Thursdays or Fridays, unless the delivery is within Texas, where orders typically arrive in 1 business day. If you are unsure whether the plant you have ordered falls into this category, please contact us via chat or email for clarification.

Planting Preferences

Most trees and plants can be planted safely year-round, but some gardeners prefer planting in warmer weather. If you'd like to delay your delivery date, please call us at (833) 873-3723. We're happy to work with your preferred schedule!

Damaged Package

At Simply Trees, we pride ourselves on the exceptional care we take in packing our plants and trees. If a package arrives with severe damage, please refuse the delivery so it can be returned to us by the carrier. Should you accept a package and later find your plants damaged, we kindly ask you to file a claim with the carrier. For assistance or more information on filing a claim, please reach out to our customer service team.

30-Day Guarantee

At Simply Trees, we're committed to your satisfaction. If your plants arrive considerably damaged or sustained damage beyond the point of recovery, please contact us within five days at sales@simplytrees.store with clear photos for assistance. Our 30-day guarantee covers issues after planting, subject to our terms and conditions. We can't cover plants in the wrong climate or with inadequate care, but we're here to help in other situations. For a detailed understanding of our 30-day guarantee and how we ensure a fair process, click here to learn more.

Your satisfaction is essential to us, and we genuinely value the trust you've placed in Simply Trees. Thank you for your understanding, and let's work together to make our world a bit greener, one tree at a time!

Quality and Damage Concerns

At Simply Trees, our goal is to help you thrive with your plants and trees. If your plant arrives considerably damaged or sustained damage beyond the point of recovery, please notify us as soon as possible. We ask that you provide clear pictures within 5 days of delivery and send them to our email sales@simplytrees.store so we can assess the situation. This period begins on the date our carrier reports as the delivery date and expires 5 days following that date. This documentation is crucial for us to assess the situation and offer you a solution. Timely communication is essential for addressing quality and damage concerns, as we may not be able to assist you otherwise.

Note that missing leaves or minor changes to the plants during shipping do not constitute damage, as these are expected parts of the acclimatization process. Plants or trees being slightly shorter than expected do not qualify as damaged or defective and, therefore, cannot be returned or be eligible for store credit, refunds or replacements.

Returns

Given the fragile nature of living plants and trees, we have specific guidelines regarding returns. We do not accept returns or exchanges due to the living nature of plants and trees. Instead of sending the plant back to us, we suggest you either plant it, compost it, or gift it to a friend or family member, helping in our collective effort to promote a greener world.

Please note, plants or trees being slightly shorter than expected do not qualify as damaged or defective and, therefore, cannot be returned or be eligible for store credit, refunds or replacements.

By purchasing nursery stock, customers agree to Simply Trees' terms and conditions of sale, which make up the entire agreement. Our liability will not exceed the cost paid for the customer's order under any circumstance.

Cancelling Orders

We totally get that sometimes plans change, and we'll do our very best to be accommodating when it comes to cancellations or adjustments to your order. Just a heads-up: if you need to make any changes, please do so within 12 hours of placing your order to avoid any extra charges.

After that window, we're likely busy picking out the perfect items for you and getting everything packed up. If your order is already fulfilled or in transit to you, a re-stocking fee of 25% of your order value will apply. Additionally, once your order has been shipped, we are unable to cancel it. By placing an order with us, you agree to these terms.

If you have any questions or concerns, feel free to ring us up at (833) 873-3723 or email us at sales@simplytrees.store. We're always here to help.

Assessing Tree Health

To check if your tree or plant is still alive, conduct a scratch test by gently scraping a small section of bark on the trunk with a coin or your fingernail. If you see brown or black beneath the top layer, the tree is likely dead. However, if you see green, your tree is alive and should leaf out again, particularly if you're checking during fall, winter, or early spring when most trees and plants are dormant or semi-dormant.

If your tree's growth has slowed or stopped during the growing season, it may have shed leaves as a temporary self-pruning measure. Trees and plants might lose their leaves after shipping, transplanting, or as a reset. Your tree should recover soon!

Disclaimer: Mother Nature's Unpredictability

We cannot control Mother Nature. While we'd love to guarantee the success of every tree and plant, we can't. Factors like animals, trees planted outside recommended growing zones, neglect, severe weather damage, drought, disease, and poor soil conditions can adversely affect plants. Plants are living organisms and face daily unpredictable circumstances. We strive to provide quality products and build customer relationships based on trust and reliability.

It's crucial to do your research as well! Plant information and recommendations can be tricky in the world of horticulture. Our growing zone map and certain product specifications may not account for specific microclimates, unusual landscape conditions, or local weather. Wind and weather protection, mulching, and regular pruning also affect your trees and plants.

For questions about plant hardiness or the best trees and plants for your area, contact your local County Agricultural Extension Office.

Note: Images and videos on our product pages might not display the exact cultivar depicted. Unless otherwise noted, our images show trees and plants at maturity to give you an idea of your future landscape or garden. Typically, your tree or plant will not look as pictured upon arrival. Younger trees are naturally slimmer and less branched than mature trees but will grow fuller over time.

Dormancy in Trees & Plants

Most trees and plants that bear leaves experience dormancy or semi-dormancy from fall to early spring. During this time, they remain healthy but may have fewer leaves, discoloration, or complete leaf drop.

This natural process is vital for the plant's well-being and eases the transplant process!

In fact, planting during dormancy promotes root growth, providing your tree with a better start in the spring when new foliage emerges. We purposefully extend dormancy in our trees during spring to ensure a smoother transition. It is possible that the trees and plants we ship are still dormant, even as local trees begin to produce leaves. Just give your plants a few weeks, and they will soon display new spring foliage!

Note: We will not accept claims for plant loss due to dormancy until they have been planted in the ground and given sufficient time to exit dormancy. We prune our trees and plants before shipping, free of charge. While this may temporarily reduce your tree's size, it promotes growth for a larger, fuller appearance in the spring.

Received the Wrong Tree?

We take great care in accurately labeling all plant varieties. If your purchase is mislabeled, we will replace your shipment at our expense. Simply contact customer service at sales@simplytrees.store and provide pictures of the mislabeled products. Our liability limit is detailed in our Terms of Service.

Growth Rates & Plant and Tree Sizing

We provide growth rate information for our products based on ideal growing conditions and published data. However, it's essential to remember that trees, like humans, all grow differently!

We cannot predict the exact growth rate, fruit production, or flowering of your trees. Each plant is unique and requires proper care in a suitable environment. As every plant, home, and landscape is unique, your results may vary.

Please be advised that the size of the plants or trees you receive may vary slightly from the dimensions listed on our website. Various factors contribute to this variation. The time of year is particularly significant; certain plants may naturally go through a seasonal slow-down, meaning they may not arrive at their peak height. Additional variables, such as weather conditions and soil quality, can also impact plant size.

Our fruit and citrus trees are often used as outdoor patio or indoor plants, and are grown in pots. For this reason, the height measurements provided for these trees are taken from the base of the pot to the top of the tree, to ensure precise and consistent sizing information for our customers.

It's important to remember that, unlike apparel like shirts or pants that have fixed dimensions, plants and trees are living organisms that grow. The beauty of nature is that these plants and trees will, given appropriate care, grow to their expected mature height over time.

In light of these inherent variations and natural growth patterns, we do not offer refunds or replacements for plants and trees that arrive a few inches shorter than the dimensions listed on our website. As long as the plant or tree is healthy, you can expect it to grow. We pride ourselves on providing premium quality plants and trees, many of which are unique and hard to find at local nurseries. Therefore, we believe they are well worth the wait and any minor size variations that may occur.

By proceeding with your purchase, you acknowledge and agree to these terms concerning plant and tree sizing.

Pot Sizes Explained

The container sizes we mention for our trees and plants are based on the industry-standard trade gallon, which is smaller than conventional gallon measurements. Before shipping, some plants may be burlapped, pruned, or tidied up. Learn more about sizing here.

Deciduous and Pruned Trees

Young deciduous trees may exhibit minimal or no branching. Additionally, we prune branches from young trees to encourage faster growth and better branching later on.

Upon arrival, your young tree may appear smaller or thinner than expected, but rest assured: In one or two seasons, it will grow taller and develop more branches!

Store Credit for Non-Shippable Fruit and Citrus Trees and Plants

If you place an order for a fruit or citrus product and we determine that it cannot be shipped to your location due to USDA, state or regional shipping restrictions, we will issue a store credit for the full purchase amount. This store credit can be used for any future purchases on our website and does not expire. Please note that this policy applies to orders placed from outside the state of Texas or from any states to which we are unable to ship fruit or citrus products. We appreciate your understanding and are here to assist with any alternative solutions to meet your gardening needs.

Regional Variability in Plant Information

Please note that the information provided for each product, including but not limited to plant care, planting instructions, watering requirements, sunlight exposure, bloom time, and deer resistance, is based on general guidelines and may not account for the specific variations encountered in different species, climates, locations, and weather conditions. These factors can significantly influence the particular needs and behavior of each plant. We encourage customers to consider the unique environmental conditions of their region when applying the provided guidance, as local climate and weather patterns play a pivotal role in a plant's health and performance.

Image Representation of Plants and Trees

Clarification on Plant and Tree Maturity in Images:

We would like to inform our valued customers that the images of plants and trees featured on our website often depict mature specimens. These images are intended to provide an accurate representation of the plant or tree at its full maturity, showcasing its mature appearance and size.

Please be aware that the majority of our plants and trees available for purchase are in their youth and have not yet reached full maturity. As such, they may significantly differ in size, shape, and overall appearance from the mature specimens shown in the images.

It is important for customers to understand that the plants and trees they receive may not immediately resemble the fully grown versions displayed on our website. These young plants and trees will require time, care, and suitable growing conditions to reach the maturity depicted in our images.

We encourage our customers to consider this information when making their selections, and we are always available to provide guidance on the growth and care of our plants and trees to help them reach their full potential.
